		<description>I&#039;m 22 years old and my partner is 23. I&#039;ve been with him for 2 1/2 years and we are both genuinely respectful and courteous to others. We are cooperative, honest and this event was a turning point in our relationship and lives as well. We deffinitely learned a lesson. Anyway, both me and my partner had experienced a heated argument which led to an unfortunate result. Me and my partner were both given a misdemeanor citation for PC 243(e)(1) by City college campus police. This is in the state of California. I believe the college police detained us because my boyfriend was told by one officer to &quot;Sit down&quot; and my boyfriend asked him &quot;Why do I have to sit down?&quot; and the officer told him in an aggressive tone &quot;Because I said so.&quot; These were the exact words exchanged. I was also told to &quot;have a seat.&quot; The two officers kept us there for questioning without reading us our miranda rights. I felt we were both victims of direct self incrimination. After doing my own research, I&#039;m educating myself on this situation because neither of us have ever had trouble with the law before. I am scared, I really don&#039;t know what to expect. Aside from these campus officers not reading our miranda rights at any time during the whole process, I was also asked if I had any weapons on me, then searched by a male officer when I admitted to having a weapon in my bra for protection. I made clear that it was for that reason only. When the officer was removing it, he reached in from the side of my bra and removed it, as the other officer stood and watched. This was also in a public setting and I felt very uncomfortable. I have to appear in court sometime in august. Can anything I tell a public defender be used against my partner? This is a great question.  If you want to fight it, you need to demand a trial.  You can start with a trial by declaration (in CA) first, and if you lose, demand a court trial.

If you have an IPHONE, you should right now take a screen shot of your call list (all calls) for that time.  Do you know how to do that?  Get the screen on your phone up.  Then press and hold the round button and the sleep button on top at the same time.  That will save a picture of your screen for evidence. 

Then, take a look at the exact citation you were cited for.  Read it. In CA, I think the statute excludes touching the phone TO DIAL a NUMBER!!!!!
